The thoery of Sustenance of Political Party in India, and its predictable outcome

The fall of Modi's regime sooner than later is predictable.

Confidential Report system of evaluation in the light of Natural Justice

Handling a Confidential Report: A confidential report (of CR) regarding an employee is violative of the Principle of natural justice in that it does not give the party being reported of a fair chance to produce his side of the story. Principles of natural Justice require that both the parties involved in a dispute be given equal chance to represent themselves before a  justice is reached. However , the CR becomes inevitable when the person being reported of is not likely to yield a sporting, a healthy hearing to his report. It is important to note that the central point is just about hearing itself, not whether the person who is being reported of is agreeing, accepting, or admitting to the veracity of the report or not. It is generally expected of the good people, or a good personality trait that a person confront his own shortcomings and work towards correcting those deficiencies in his behaviour. Hence, it becomes all the more important that the appraisal of the pe...

Discretion and the 'change which we seek'

Let us do some dissection of the Bharti-SHO scuffle to know what all went, and against the ideal way of doing things.       To start, let us create a simple analogy which we will use later to help simplify and understand the event.    Consider a police checkpoint where a lots of people are passing by. The police stops a few people to check their passes and catches hold of one person without a proper document (e.g. His bike registration/driving license.). This man argues with the police on being caught and makes a certain allegations on them. 1) He accuses the police of being biased against him because a lot many people had slipped through the checkpoint whom he knew didn't have the proper documents either, but were not checked by the police. Can his argument be held valid- that the police acted biased targeting him in particular, for the reason that many had slipped through the checkpoint? The law courts have generally disregarded such argument thereby up...

Really! a case of Indiscipline and Disrespect ??

Acts of 'Indisciple' and 'Disrespect' are two accusations which in themselves are deprived of any logical substance to sustain themselves. What is 'indiscipline' and what is 'disrespectful' or 'insulting' in an action is never revealed by the use of word itself. Where one person will judge 'indiscipline' in an action, the other person may still see discipline while negotiating hard to change a culture towards the deliverance of the justice. Given the manner these words are used, it can be said that the parameters of 'discipline' and 'indiscipline' are very much subjective and particular to the cultural environment of the claimant and the organisation.   More often than not, the claims of a perceived 'indiscipline' or a 'disrespect','insult' comes as a front for the suppression of Free-speech , or to overthrow what ought to be the course of Justice in a given case. It is very common to see the claim...

Rethinking : Discretion versus Decision-making

(refer previous blog: Difference between Discretion and Decision-making ) On a re-thinking about Discretion -Versus- Decision-making, Discretion is something which allows space for person taste of the leader to play bigger role in the proceeding. In dictionary, Discretion is described as "Good Judgments". However , in management/administrative theories the area of interest of 'Good Judgements' grows outward to enquire the "how?" , the methodology of making a 'Good Judgements'. Management/administrative theories therefore proceed to create distinctions between Decision-making and Discretion. Discretion, here, is differed by a factor of 'personal taste' from Decision-making. Decision-making is about picking the best choice from various options being explored; Discretion is about acting solely by 'Personal Taste'. Therefore the term 'Discretionary Power' stands separate from the ordinary power of decision-making which is an ele...

The limitations of your gratitude to your MNC for giving you an employment

There is an intrinsic connection between the theme of Independence, Freedom and Economic Liberty. It is here that the reasoning of why your argument that ''Let's be thankful to our company, our MNC, for giving us the employment which is so essential to our survival'', finds its limitation. It is here that the fight begins for saving an Employment from turning into slavery. The fundamental premise laid down in the Constitution of India, even expressed in the Preamble to the Constitution, promises to 'secure to all its citizens' the ''Justice : economic, social and political'', and ''equality of status and opportunity''. All employments are considered to be economic activities. So, the country and its government promises and guarantees in some sorts, to you, your means of survival, although it may or may not not be a highly prosperous one. This is done to ensure your economic freedom so to be able to fight for your rights from ...

How the treatment of consequences of Discretion differs from treatment of Decision-making

The power of Discretion is most certainly to be differed from the duty to make judicious decisions.        Dictionary defines Discretion as 'making a judicious choice'. However, in law, whether the choice is judicious or not becomes a matter of intense debate, which enforces law and management to create distinction between Decision-making and Discretion.       Every man born has a discretion available to him. Shakespeare tells us that a man is a slave because he has so chosen to be. He can always liberate himself by taking his own life. Thus a most fundamental discretion to commit suicide exist with everyone.      Other times ,people in authority have discretion, desired and undesired, to pick people 'at random' from the lot for exercise of authority. A policeman on duty has discretion on whom to pick when a number of people are in violation of speed limit law. No judge, no person can argue with him , 'why did you pick me only for ove...

Thieving Decision-making

Thieving Decision-making In India, due to general ignorance on law matters, people at decision-making positions sometimes act a little whimsical by allowing themselves to assume that if any decision they are taking is being reasoned by someone else to be ' prima facie ' wrong then someone would complain against that decision. This kind of decision-making has double advantage..it gives them liberty to stand and live lifelong ignorant of the law, and later claim/feign ignorance of the law if they are caught in a misdeed which they 'might have' intentionally carried out .  Is their a name for Such actions of the bureaucrats, Politicians, or Managers at Senior Ranks? Can these acts be prosecuted under the claims of "Mental anguish"? Can the person be held liable to be 'incompetent for the Rank', as he might erect on line of defence for his decision-making as " Nobody told me! I thought if my decisions were wrong then someone will come out with the...

Difference between Discretion and Decision making

Discretion and Decision-making are not the same things. To understand the difference, take the example of a Person 'A' who is planning to go to a party. He has three apparells of three colours. The choice of colour that 'A' has to make from those three apparells is the Decision-making. But his prerogative to go to a party altogether or to not to go, is his Discretion. In Discretions, he by-passes the need for a decision-making from the limited choice of the three colours apparells completely. 'A' may also exercise Discretion to be in clothes or without clothing, thereof avoiding the decision-making, although that will not be socially acceptable, unless ofcourse he is going to a nudist club party. There is always a little bit Discretion in every decision-making a person has to do. One can always exercise Discretions in such a way to avoid arriving at the cross-roads of decision-making. A police man can decide on the acceptability of your driving liscence after l...

"Mathematical representation of Decision Making"!! Did you know that??

Image
Here I give the website link of a very interesting page I have found on the Internet. It is pertinent to mention that such pages and methods are part of the MBA Curriculum I am studying in the IGNOU. This is a mathematical proving of an argument presented by it's author, wherein he argues that why Authoritative Decision-making is better than the Democratic Decision-making.  How many of us, indulging in the mere philosophical conversations of what is the best have ever found in the pure subjects, the mathematics in this case, the proof of what we are arguing for ?? That is the wonder and hallmark of the work, which is why i felt like preserving it and giving it away for the knowledge of the people who did not have any inkling. Letter to the DPA in regard to style of Management on board ships

Dear Capt Leboffe: I am writing this mail to express some thoughts I have in my mind after attending the seminar. I was initially intending to talk to you about my promotion, as to what are the company plans on this. There was a collective meeting organized with all mates, masters, second engineer and chief engineers in a room, which I had also attended. Here is a summary of inferences I could draw up on this meeting and the seminar as a whole . In the room, the most common question that people sought to know was about the promotion policy and its sincere implementation. Even when already in know of the standard answer of the company, which is ‘three recommendations from three different masters’, I think the more discreet question people wanted to seek was – what?, if the aspirants are finding it hard to obtain the three recommendations. The appraisal report and system came under scrutiny at this juncture. Some people , particularly old masters, believed that closed appraisal ...
