Because the perpetrator can NOW give differential treatment to two persons, selecting it on irrational basis such as the CASTE , both having commissioned a similar level of offence And yet the perpetrator may most comfortably escape detection of having done a discrimination. The irrational basis could also be , The political inclination of the wrongdoers For example, the goons who support a political group, - the one in power- may be let off by the police authorities Whereas the goons who are supporters of the opposition, are "encounterd" or demonised in the public space.
