Linguistic Inability: Respectfulness or Courteousness ?

It was disheartening to listen to a lawyer's views who was teaching-talking to his class about being Respectful to seniors. The lawyer-cum-teacher spoke from his personal life experiences that respectfulness brings you a lot of success. Elaborating it further, he said that even where you have a Right - fundamental, legal, or moral- you should still be respectful, and instead of making a demand for enforcement of your right, you should make a request from your senior to please grant you that Right.

I had an intuitive feeling for long time that the legal academia in India is disturbingly poor. Today I was faced with one such product of the ruined education culture which perhaps has emerged from a combined effect of 1000 years of slavery, syncretic culture, as well as a generation of caste-based oppression.
In my observations, the deepest damaging impact which the slavery, syncreticism and caste-based mutual oppression has left on our generation of citizens with is-- the Mutilated Conscience. Our Conscience has twisted, bent and corrupted our mental abilities too, herein about the Linguistics, which in turn has made us conduct crookedly without any awakening, inner voice call. 
      Its the conscience which has made us behave naturally subjugated to the use of English Language; and it has caused our generation to suffer certain mental linguistic disabilities 【Austism spectrum of mental inability, such as the Semantic Pragmatic Disorder (SPD), Pragmatic Language Inability (PLI)】 in which the words don't mean what is intended, and vice versa,-- what is intended is not spoken in the right, lucid vocabulary.

In my view, the lawyer teacher should have talked about a general courteous behaviour, instead of the "respectful" behaviour. From the descriptions of what he called as "respectful", an average Indian student coming from a rural, unpolished setup would draw a lesson which most closely would that be of a chained pinion groveling in the dust.
A slightly thoughtful mind would feel pressed to question himself if Respect is meant only for the senior, or even to the juniors? or worse, to the strangers too? What then was the good sense of the word Respect that the lawyer-teacher was wanting to speak of ? Would not a disrespectful behaviour to junior amount to bullying or harassment , which are illegal unto themselves? Did the lawyer not realize this aspect of the general Respect which he was talking about?
   A general courteous behaviour is a human call, and in legal logic, it serves the purpose of saving the loss of sense of one's arguments before his esteemed opponent,and the honourable court. Doesn't it ? Sans the courtesy, every one will be cautioned to look for other alternate meanings, without feeling obliged to asking you to explain yourself.
   Perhaps what the lawyer-techer should have been addressing his class was about Courteousness, not Respectfulness. A lawyer is expected to be brutally truthful, and unhesitant to criticize whatever was wrong in his beliefs. A lawyer is also expected to serve the society by spreading legal consciousness among the citizens, and help them secure their constitutional and legal rights. A right begged from someone by being respectful is not a good lesson to teach. What needed be taught is about remaining civil and courteous even while DEMANDING for your Rights. A lawyer in his career span may often be required to hard-insist upon some of his arguments. Where does the instance of Hard-insistence count ? Disrespectfulness, or simple discharge of lawyer's duties?
  Further, what value is the event of Disrespectfulness from the Justice point of view ? Can and should a person be denied his Right on the grounds of not being Respectful while arguing for it ?
     The lawyer-teacher was more more than inadequate to my inner fulfillment.

पेशे से वकील, उस अध्यापक के विचारों को सुन कर मन को कष्ट हुआ जिन्हें की वह कक्षा में विधि विधान के पाठ के रूप में सुना रहा थे।
   वह अपने जीवन अनुभव की बात करते हुए कह रहा था कि अपने से बड़ों को सम्मान(respect) देने से वकालत जीवन में बहोत उपलब्धियां प्रात होती हैं। अध्यापक ने यह भी कहा की आपको सम्मान(Respect) उन जगहों पर भी देना चाहिए जहाँ आप अपने अधिकार को सुरक्षित करने की बात करना चाहते हों। इसलिए अधिकार माँगने की बजाये अपने से बड़ों को सम्मान देते हुए अधिकारों को संरक्षित करने के लिए प्रार्थना करिये, गुज़ारिश करिये।
  आगे उसने कहा की कभी अपने जीवन में अपने से बड़े लोगों को बहोत-बहोत सम्मान दे कर देखिये,-- आप अत्याधिक सफलता का अनुभव करेंगे। आपका जो काम यथाविधि संभव नहीं था, वह भी पूर्ण हो जायेगा।

  मेरे विचार में वकील-अध्यापक एक भाषाविज्ञान त्रुटि कर रहा था। जहाँ शालीन(decent) या भद्र(civil, courteous) शब्द का प्रयोग होना था, वहां वह सम्मान(respect) शब्द का प्रयोग कर रहा था। फिर, शब्द की अदला-बदली हो जाने से विचारों की रेलगाड़ी पटरी बदल कर किसी और ही स्टेशन पर चल निकली थी। उसके विचारों को सुनते ही मन में एक कटाक्ष आ रहा था कि यदि वह कहता है की अपने से बड़ों को सम्मान देना चाहिए, तो क्या हमें अपने से छोटों को सम्मान नहीं देना चाहिए? अपने से छोटों से हमें कैसा व्यवहार करना चाहिए? और किसी राहगीर अनजाने से कैसे व्यवहार करना चाहिए? क्या वहां सम्मान नहीं देना चाहिए ?
    बार बार मुझे स्मरण आता है की हमारा देश भारत करीब एक हज़ार साल की गुलामी के बाद मुक्त हुआ है। हमारी संस्कृति "गंगा जमुनवि" है जो की एक साथ दो विरोधाभासी विचारों को समर्थन करती है, यानि भेदभाव और पक्षपात हमारी संस्कृति का अंश है। हमारा समाज सदियों से जाति-गत भेदभाव वहन करता आया है। इन समस्त कारणों ने हम भारतियों में बहोत सारे चरित्र दुर्गुण पैदा कर दिए हैं। इन द्वेषों के प्रभाव में सबसे ज्यादा विभित्स हमारी अंतरात्मा हुयी है, जिसने की अब धूर्त और कुटिल तर्कों और विचारों को जीवन का सत्य माना अपनी आदत बना लिया है।
    हमारी अंतरात्मा की मूर्क्षा ने हम लोगों में कई सारी मानसिक अक्षमताएं उत्पन्न कर दी हैं। भाषाविज्ञान जनित अयोग्यता उन अक्षमताओं में से एक है। यह एक किस्म की आटिज्म सप्तरंग विकृति है - जैसे कोई प्रयोगार्थक भाषा विकृति, या कि Semantic Pragmatic Disability. इसमें प्रयोग करे जाने वाले शब्दों का अर्थ यह तो वह नहीं होता जो उद्देशित होता है, या फिर जो वास्तविक मंशा होती है उसको दर्शाने वाले शब्दों का चुनाव ठीक से नहीं कर पाते हैं। अध्यापक भी कुछ पल के लिए उन्हीं अयोग्यताओं से पीड़ित होता हुआ लग रहा था।
      अध्यापक को कक्षा में भद्रता का पाठ सिखाने की आवश्यकता थी, सम्मान देने का पाठ की नहीं। कभी कभी मैं सोचता हूँ की ग्रामीण क्षेत्रों से आये छात्र  'किसी अपने से  बड़े व्यक्ति को सम्मान देने' का भाव ज़मीन पर लोट कर गिड़गिड़ाने से तो नहीं निकाल लेंगे। क्योंकि यदि वकील भी यह पाठ सिखाये की अधिकार माँगना नहीं चाहिए, बल्कि गुज़ारिश करना चाहिए, तब फिर गाँव की जमीदारी भुगत कर आये व्यक्ति स्वाभाविक तौर पर पुनः अदालत की प्रक्रिया और कार्यवाही में भी उसी जमीदारी व्यवहार की कल्पना करेंगे। "अपने से बड़े" का अर्थ उनकी सीमित कल्पना क्षमता में वापस उनके गाँव के ज़मीदार जी से विस्थापित कर देगा।
   अध्यापक , चूंकि वह पेशे से खुद भी एक वकील था, क्या उसने एक बार भी नहीं सोचा की किसी भी नागरिक को उसके संवैधानिक और न्यायिक अधिकारों से एक लिए वंचित किया जा सकता है की उस नागरिक ने किसी को "सम्मान" नहीं दिया ?
   किसी व्यक्ति द्वारा अपने तर्कों और विचारों की कठिन, पुनरावृत्त और मज़बूत गुहार लगाने को क्या यह अध्यापक एक असम्मानजनक व्यवहार मानते हैं ? ऐसा अक्सर देखा गया है की जहाँ सम्मान को न्याय तुला में स्वीकृत पक्ष मान लिया जाता है वहां लोग पुनरावृत्त गुहार लगाने को भी असम्मानजनक आचरण जाता कर अन्याय को पारित करवा लेते हैं। एक वकील को तो अपने पेशेवर जीवन में कई बार पुनरावृत्त और सशक्त गुहार करनी पड़ती है। इसे अपने कर्तव्यों का निर्वाह मानेंगे या फिर असम्मानजनक आचरण ?
   
     वह अध्यापक मेरे चित्त को शांत कर सकने में बहोत अपर्याप्त था।
