Confidential Report system of evaluation in the light of Natural Justice

Handling a Confidential Report: A confidential report (of CR) regarding an employee is violative of the Principle of natural justice in that it does not give the party being reported of a fair chance to produce his side of the story. Principles of natural Justice require that both the parties involved in a dispute be given equal chance to represent themselves before a  justice is reached. However , the CR becomes inevitable when the person being reported of is not likely to yield a sporting, a healthy hearing to his report. It is important to note that the central point is just about hearing itself, not whether the person who is being reported of is agreeing, accepting, or admitting to the veracity of the report or not. It is generally expected of the good people, or a good personality trait that a person confront his own shortcomings and work towards correcting those deficiencies in his behaviour. Hence, it becomes all the more important that the appraisal of the person

Discretion and the 'change which we seek'

Let us do some dissection of the Bharti-SHO scuffle to know what all went, and against the ideal way of doing things.       To start, let us create a simple analogy which we will use later to help simplify and understand the event.    Consider a police checkpoint where a lots of people are passing by. The police stops a few people to check their passes and catches hold of one person without a proper document (e.g. His bike registration/driving license.). This man argues with the police on being caught and makes a certain allegations on them. 1) He accuses the police of being biased against him because a lot many people had slipped through the checkpoint whom he knew didn't have the proper documents either, but were not checked by the police. Can his argument be held valid- that the police acted biased targeting him in particular, for the reason that many had slipped through the checkpoint? Aam Aadmi Party , Somnath Bharti and the Khirki Extension 'raid'

( a compilation of my posts on Facebook related to the above matter) 20th Jan AAP being accused of being a 'Vigilante' or of showing a 'mob mentality' in reference to the Law Minister-Police scuffle, can only be a social question. Being a 'Vigilante' or showing a 'mob mentality' in regard to the working of police department is NO crime in the legal sense, for which a person may be punished by a law court. It can only be a social question - as to whether the society is ready  to accept such behavior from certain people or not.  I am personally not in favour of the 'vigilante' behavior shown in this case. However so far as the question of 'change that we seek' is concerned, the conduct of the AAP's law minister cannot be dismissed away as wrong. Afterall , till this day the existing system has always taken advantage of the absence of fear of a 'vigilante' and 'mob mentality' to mould itself the way it is! There exi

शिक्षा का अधिकार और राज्य का उत्तरदायित्व

       शिक्षा का अधिकार एकमात्र ऐसा अधिकार है जो की एक अधिकार कम है और एक बंधन, एक उत्तरदायित्व ज्यादा है । पढ़ने वाले बालक, छात्र, पर बंधन होता है कि 'पढो', और पढ़ाने वाले अध्यापक पर उत्तरदायित्व होता है की 'पढाओ'| सयुक्त राष्ट्र द्वारा घोषित अंतर्राष्ट्रीय मानवाधिकारों में यह एक ऐसा मानवाधिकार है जिस पर यह विवाद, यह आरोप रहा है की यह अपने आप में ही मानव स्वतंत्रता की विरुद्ध है। किसी मनुष्य को शिक्षा ग्रहण करनी है या की उसकी चाहत ही अशिक्षित रहने की है - यह भी प्रत्येक मनुष्य की स्वतंत्रता में आता है। मगर मानवाधिकार शास्त्रियों का तर्क रहा है की चूंकि बाकी अन्य मानवाधिकार का संरक्षण खुद प्रत्येक मनुष्य के अपने मानवाधिकारों के आत्मज्ञान पर ही निर्भर करेगा इसलिय प्रत्येक मनुष्य को कम से कम इतनी शिक्षा तो अनिवार्यता से लेनी ही पड़ेगी की उसके मानवाधिकार क्या है। इस तर्क का अर्थ यह है की शिक्षा को अनिवार्य तो करना पड़ेगा मगर सिर्फ इस हद्द तक ही की कोई भी बालक या मनुष्य यह जान कर, सोच-समझ कर चुनाव कर सके की उसके अधिकार क्या-क्या है, और कि उसे शिक्षा लेनी है की नहीं। इसी विचार

Who is Aam Aadmi and what should he be wanting?

कौन है यह आम आदमी और इसको अपने लिए क्या चाहत रखनी चाहिए ? असल में "आम आदमी" शब्द एक पर्याय है एक ऐसे समाज के व्यक्तियों के लिए जिसकी चारित्रिक विशेषताएं यही हैं जो नीचे लिखी हुई हैं । इसमें कोई शक नहीं है। शेक्स्पेअरे ने इन्हें "प्लेबेइअन"(= निचले तबके के लोग) कह कर बुलाया था और प्राचीन रोमन साम्राज्य में भी इन्हें ऐसे ही पहचाना गया था ।    मेरी समझ से समाज अपनी बौद्धिक जागृती और नैतिकता के आधार पर दो प्रकार से प्रकट होते हैं : 1) आत्म-जागृत समाज conscietious society , और 2)अनुपालक समाज complaisant society। इन दोनों प्रकारों में अंतर और विशेषताएं क्या हैं?        क्रमिक विकास की दृष्टि से अनुपालक समाज एक पिछड़ा स्वरुप है एक आत्म जागृत-समाज का । अनुपालक समाज किसी नेता, किसी स्वामी, किसी राजा के आदेशों का पालन करना चाहता है। वह स्वयं से, अपने अंतःकरण के आधार पर नैतिकता के विषयों को नहीं तय करता है। ऐसे समाज में नियम कोई अन्य लिखता है और जनता का कार्य होता है कि नियम को जान कर उसका पालन करे। यहाँ नियम-कानून साधारण ज्ञान का विषय नहीं है जो की आप स्वयं अपने अंतःकरण क
